Summary, etc. La 4e de couverture indique : "Le concept de biom�etrie, entendu comme un ensemble de techniques produisant une information �a partir d'une mesure corporelle (empreintes digitales, g�en�etiques, photographies) afin de la comparer avec une donn�ee pr�eenregistr�ee, n'avait pas encore fait l'objet d'une �etude juridique d'ensemble. - �A partir d'une �etude des notions juridiques de corps et d'identit�e, cette th�ese s'appuie sur les fonctions d�eclar�ees ou latentes de la biom�etrie pour en montrer la pluralit�e et en singulariser la continuit�e. - En se fondant sur l'utilisation de la biom�etrie en tant que mode de preuve de l'identit�e de la personne physique, il a �et�e possible de retracer une �evolution des fonctions, partant de la fonction identificatoire des fichiers de police pour tendre vers une identification en temps r�eel. Cette finalit�e a pour corollaire une autre fonction latente, mais structurelle : la localisation des personnes physiques. - Cette fonction irrigue l'ensemble des utilisations des syst�emes biom�etriques, sans pour autant �etre pr�ecis�ee, en tant que telle, par le droit positif. - Pourtant, son existence modifie profond�ement la conciliation op�er�ee entre la d�efense de l'ordre public et la protection des droits fondamentaux, au d�etriment de ces derniers. De mani�ere plus g�en�erale, cette th�ese porte sur la difficile transposition des hypoth�eses scientifiques en v�erit�e juridique. Le retard du droit n'est alors plus transitoire, mais structurel �a son appr�ehension des sciences des techniques."
